Section 1610 of Public law 104-201) provides (in part):
If Compensatory Time is not used before it ages 26 pay periods, it will automatically be paid out from current payroll funds at the overtime rate at which it was earned.
Federal Wage System (FWS) employees are now eligible to earn compensatory time.
Compensatory time will no longer be paid out when an employee transfers from one unit identification code to another.
Compensatory Time will be paid out only when an employee separates or transfers to another DoD agency.
